Many say that what is happening in the UK and the rest of Europe could never happen here because we have a constitution. We know of at least 50 court cases here in America where judges have used the principles of Shariah law in adjudicating, mostly over Muslims, in case concerning the custody of children, marriage, civil issues, and even in criminal cases.
Judge Joseph Charles denied a restraining order to a Muslim woman. It was a Moroccan couple where her husband was physically and sexually abusing her. The man went to Imman to get a Shariah ruling that he did nothing wrong because he was obeying his faith.
Surah 4:34 says, “Men are in charge of women by [right of] what Allah has given one over the other and what they spend [for maintenance] from their wealth….. But those [wives] from whom you fear arrogance – [first] advise them; [then if they persist], forsake them in bed; and [finally], strike them….”·
When this was presented to Judge J. Charles he ruled:
“No criminal desire to or intent to sexually assault his wife.”
It is amazing that an American judge would consider Islamic law in such a case. This is a violation of our Constitution. Here are links to the notes on two broadcasts detailing how Islamic law violates the First Amendment:
The passage above gives three steps in dealing with a disobedient wife. They are to warn them, provoke them to jealousy by giving themselves to their other wives, and finally, beat them. In this country beating one’s wife is called assault and it is a criminal offense. He was also raping her and forcing her to have sex, which is another criminal offense.
The husband was not disputing that he had done those things. He was admitting he had done them, but was claiming the right to do so based on Islamic law.
You would think that in America, American laws would trump any foreign laws. This principle is in our Constitution. It says that the Constitution is the supreme law of the land. On non-federal laws, that is state laws, unless the state’s constitution has a similar statement, they have the liberty to consider other legal systems. You would think that common sense would not allow this, but you can see that not everyone has common sense.
If we don’t fight back against this, there is a principle in American law called precedence. This means that if there is a ruling on a similar case, it sets a precedence, and can be used as a basis for future rulings. We need to get behind the movement for American Laws for American Courts (ALAC). If we don’t this principle of precedence will work havoc in our legal system.
The good news is the Alabama, Arizona, Florida, Kansas, Louisiana, North Carolina, Oklahoma, Tennessee, and Washington have passed versions of this law. In Washington it only covers specialty courts. This is nine of the fifty states. Forty-one still need to get this kind of law passed. Some of you live in some of the states that have not passed the law.
Fortunately other states are also working to get ALAC passed. It is critical that if your state does not have this law, the citizens, that includes you, must pressure the lawmakers in your state to pass it.
The laws of America were originally based up common law. Common law is law based upon nature and nature’s God or the Ten Commandments. Today our system is based upon case law. This is what I was talking about when I mentioned precedence. This means that one judge and rule as did Judge Charles he sets a precedent and another judge can use that precedent in his ruling, and another, and another, building the precedence.
The Courts Are Just One Front Of Cultural Jihad
Halal Meat is another tool used in cultural jihad. This is the meat that Muslims believe they must eat. This meat must be sacrificed to Allah in a certain manner. It must have the blood drained facing east toward Mecca.
If you buy Kirkland lamb at COSCO that they are buying Halal meat. The butterball turkey you buy for Thanksgiving was Halal. When this came to light there was a push back by customers who didn’t want to buy meat that was sacrificed to Allah and prayed over by an imam. Butterball has now changed their policy.
This may not seem like much, but it is part of the cultural jihad. It is part of slowly changing our culture and brining it in line with Islamic law.
I have no problem if a Muslim wants to eat Halal meat he has every right to do so. There are stores that cater to Muslims and sell Halal meat. I do, however, have a problem when the force Halal meat on non-Muslims.
The Jewish people have kosher meats. They don’t try to force it upon non-Jews, and it is clearly labeled so everyone knows that it is kosher. This allows each individual to make his own choice on the matter..
